Side Notes – “DuiThink”

We take our juror’s as we find them. You cannot change a juror’s worldviews that are firmly entrenched in her mind. If her worldviews are on the end of the bell that is that conflicts with the story of your case, then don’t waste your time watering down your message.  You will not be able to change the way she sees world.

However, there are bell curves within bell curves. Thus, even in the group of jurors with the worldview predisposed not to believe your authentic story, there will be some people on the edges you may be able to shift towards accepting your message. That is, shift their opinion just enough, to listen to the members of the jury who more readily accept your story.  The members of the jury whose worldview coincides with the story of your case are the ones who will truly do the advocacy to the other jurors on the edges of the bell curve.

Here is a worldview DUI attorneys encounter in every trial: if a person was drinking, driving and arrested, not only are they probably guilty, but any chemical test result the government has, must be right. This worldview is called – “DuiThink.”
